For respondents on surveys provided through Make Opinion: We collect the answers which you give to our prequalification questions on behalf of our customers inside our application. We may ask for your e-mail address, so you can log in to our service from several devices or different publishing partners who are using the Make Opinion application.

Make Opinion keeps this information in its database to suggest future surveys which are matching your profiling information. Participation in these suggested surveys is completely non-obligatory. Furthermore, this information is shared with the survey partners. If you are a respondent and have any questions concerning our survey partners' privacy practices and your data stored, please contact the survey partner directly. Whenever we route you to one of our survey partners for the first time, their privacy policy will be shown to the respondent.

We will process your personal information lawfully, fairly, and in a transparent manner. We collect and process information about you only where we have legal bases for doing so.

These legal bases depend on the services you use and how you use them, meaning we collect and use your information only where:

  • it's necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract (for example, when we provide a service you request from us);

The personal information we collect is stored and processed in Germany, where we or our partners, affiliates, and third-party providers maintain facilities. By providing us with your personal information, you consent to the disclosure to these overseas third parties.

We will ensure that any transfer of personal information from countries in the European Economic Area (EEA) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means.

Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction. There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

If you are situated in China, please be aware that your personal information will be processed in countries outside of China, such as the USA and EU. This processing may occur due to our affiliates who have entrusted us with the distribution of their surveys or the presence of other Company affiliates, agents, or contractors in these regions. Further, you understand that your personal information will be processed outside of China in the following countries: USA, Canada, France, Romania, Israel, Pakistan and India by our third-party survey-research partners, such as Toluna and its trustees IPGeo and IPQS.

LGPD PRIVACY NOTICE

PRIVACY STATEMENT-BRAZIL

This Privacy Notice for users located in Brazil supplements the information contained in the Make Opinion GmbH Privacy Policy and applies solely to visitors, users, and others who reside in Brazil ("consumers" or "you"). We adopt this notice to comply with the Brazilian Data Protection Law Lei Geral de Proteção de Dados Pessoais (Law No. 13,709/2018) (“LGPD”). Any terms defined in the LGPD have the same meaning when used in this notice.

LGPD

On September 18, 2020, the Lei Geral de Proteção de Dados Pessoais (LGPD) came into effect for Brazilian residents. Exercising Data Portability and Deletion Rights

We will need to verify your identity before processing your request. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or a legal representative.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 15 days of its receipt but no more than 30 days. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request.

If you have provided data to Make Opinion GmbH regarding a client of yours, which is subject to the LGPD, you are responsible for obtaining the proper consent from such clients prior to sharing their personal information with us.
